In the process of traditional protection,on one hand one should pay attention to the protection of its connotation and form,making it as complete as possible to be spread down. On the other hand, one alsoneeds to pay attention to the legal protection of the traditional process, especiallyreferring to the legal protection of intellectual property rights. The protection ofintellectual property right of traditional process, first of all can not be avoided andneed legislation to regulate it, and lay the theoretical foundation and fundamentally;second is to regulate all aspects of law enforcement, judicial departments, in order tomake the work more effectively implemented; finally, it should be based on the wholeof society within the scope of acceptable degree, which requires we set out from thepsychology of the masses, from the start with the majority of the population, toachieve the ultimate goal of the protection of intellectual property rights through theenhancement of their legal opinions and rights awareness.In the current, there are a lot of international intellectual property protection forthe traditional process of precedent, and accompanied by a series of InternationalIntellectual Property Conventions promulgated, the developed capitalist countries, theprotection of intellectual property right in the traditional technology strength isincreasing. In our country, the protection system of the traditional process is notperfect, some places in the absence of the state, and legislation work no follow up,leading to the protection of traditional technology of our country is very weak, in thelawless state, academic research on this field is very weak, many issues are stillcontroversial, some basic theory and basic concept is no authoritative definition. Thispaper will start from the perspective of intellectual property, discusses the shortcomings of the current intellectual property system to protect traditional crafts,special traditional crafts and invention, compared with the commercial secrets, andpreliminary ideas on the existing intellectual property system as the basis for thespecial legislation, the protection of traditional craft comprehensive.Therefore, the process of writing this paper mainly uses data collected,summarized, comparative analysis and other methods, integrate the first summary ofexisting theories on the protection of intellectual property, and then combined withthe actual case on the basis of the above analysis are discussed, and the appropriatemethod of introducing foreign handling this kind of case method, finally draws thereasonable conclusion, and to provide the feasible advice for the future developmentof China’s intellectual property protection of traditional process, promote thepopularization and implementation of intellectual property law in the context of thewhole society.
