The right to material assistance is one of the second generation of humanrights-rights, followed the right to liberty. Simultaneously, it is a constitutionalright, the state through social redistribution of resources, protection of theminimum living members of society. Through the protection status of the right tomaterial assistance for analysis, summed up the way to protect the fundamentalrights of the moment that is the protection of state power mode, and analyze why thiskind of protection mode why failure. At the same time pointed out that thefundamental rights of a new security model in quietly rising, that the obligations ofStates to protect mode. But since this is a new fundamental right to protection mode,is relatively new practice has not been fully tested, so before using this mode toprotect the rights guaranteed right to material assistance and other types of social andeconomic rights of citizens, we need to first, in theory justify national obligations toprotect the system model in constitutional theory of legitimacy (legitimacy),followed by the practical level to prove that it can really help effectively protect theright of citizens to obtain material, and then as a foundation, trying to nationalobligations security model to expand to other types of social and economic rights,and even the basic rights of all types, and the final completion of the theoretical andnormative obligations of States to protect summed mode. As we all know, everynew thing, there will always be some problems in the early stages of itsdevelopment, the obligation to protect national model is no exception, so we affirmthis right after the security model, which may also need to find out the problems, inorder to determine the boundary theory in handy.
