The Research On The Material Assistance Right

The material assistance right is a basic right of citizens in the constitution of our country, and it plays a crucial role in the protection of civil equality, freedom, survival and development. However, in the process of implementing the constitution, implementation and development of citizens’ right to material assistance has not been paid enough attention to the state and society. The realization of the right must be from natural right stage to legal right stage. If the citizens’ material assistance right only stays in the symbolic level, the right will become a mere scrap of paper. This paper is divided into four parts. The first part is based on the analysis of historical literature, analyzing the establishment of the concept of right of material assistance, the origin of concept and the historical development of the right. The second part analyses the current difficulties and problems on development of the material help right. If we trying to take into consideration of the defect of administrative management system, legal system and the legal relief, it will clear obstacles in the way of establishing specific, standardized and normalized material help right. The third part is mainly to study the development and design of foreign material help right system. By introducing the development process of legal protection, advanced idea and the relief way in the UK, Germany and Japan, this paper summarizes the valuable experience and implement mechanism of western countries in the protection of citizens’ material assistance, for giving different aspects of enlightenment to our country’s material help right. The fourth part discusses the countermeasures of improvement of citizens’ material help right and interests, to promote the development and perfection of material help rights. To realize the right in our country, our government needs to strengthen the construction of legislative, administrative and judicial. To construct China’s constitutional protection and related laws improvement of citizens’ right to material assistance, through dynamic warning mechanism and unified administrative management system to realize effective administration.
