Research On The Public Trial Under The Condition Of Information

Public trial as a basic principle of modern democracy&rule of law, which is one of theinstitutional arrangements of the democratic supervision of jurisdiction, its core is to put thejurisdiction under the sun, let the judicial referee stand testing, deliberating and adjudicating, soas to achieve a virtuous cycle that through openness to promote justice, through justice topromote public trust. Under the erosion of information-based wave, traditional public trial ispresenting a new form, bustling with life. Realizing public trial through information network isan objective requirement of judicial justice and judicial credibility, it is also a practical need forsocial public to understand, participate and supervise judicature in the context of the informationage. Research on the public trial makes perfect sense in such an information age.This article will research on the public trial under the condition of information from thefollowing four aspects:The first part explores the basic connotation of public trial, proposing to solve twotheoretical problems of public trial, those are clarifying the concept of public trial and exploringthe essential connotation of public trial, laying a solid basis for expanding discussing below.The second part focuses on investigating three kind of traditional public trial,they are audit,live and record of the public trial, open of the written judgment, then, teasing the limitation ofthe traditional public trial on the whole.The third part analyzes the impact on the public trial from the condition of information andchallenges&problems to the development of the current system of public trial.The fourth part aimed at the problems those existing in the public trial system under thecondition of information, proposing four recommendations: creating new cyber carrier of thepublic trial, setting up the platform for the openness of the trial process, eliminating the arbitraryspace of the written judgment online and establishing relief program of the public trial.
