Administrative handling complaint reporting is mainly handled by all levels ofgovernment, and the complaint reporting handling office often serves as a coordinatingfunction. However in the practice of this coordinating function, it has not fully played its role.At the same time, the complaint reporting handling behavior of all the authorities is lack offlexibility with normative issues. So the administrative complaint handling department needsa simple, flexible and diverse way to make up the existing defects just as how we use theguidance in administrative department. Although administrative guidance has received theaffirmation of the Complaint Reporting Regulations as a way of handling behavior ofadministrative letters and visits, and administrative letters and visits processing departmentbegan to use administrative guidance to deal with a complaint reporting matter, the complaintreporting handling administrative department doesn’t have a clear knowledge about legalattributes of the relationship between the administrative guidance and the understanding, andit also failed to appropriate use of administrative guidance in dealing with the administrativeletters and visits. It doesn’t only hinder the administrative guidance from giving full play totheir advantages, but also gets in the way for the administrative complaint handling work togoes smoothly. Therefore, the complaint reporting handling administrative department needsto correct and standardize the practice of administrative guidance so as to ensurethat administrative letters and visits work carried out smoothly and effectively.Apart from the preface and epilogue, this article altogether is divided into five parts.The first part is about the present situation of administrative complaint handling systemin our country. By analyzing the provisions of complaint handling system of the central andlocal, this paper sums up the characteristics of the complaint reporting handling system infour aspects: the specific process of complaint reporting handling office on coordinating therelated administrative organs, the complication of the process, the diverse processing methods, and the institutionalization of the process.The second part aims to explore the legal attributes of administrative complaint handlingas well as the existing problems. Through classification analysis of the legal attributes ofadministrative complaint handling, we try to study their reconsideration, actionable so as topoint out the problems existing in the current administrative complaint reporting handlingbehavior. Through this study we find the existing problems as follow: the behavior of themain body is not professional enough; the treating means is too single; the treating processlacks specification; it also lacks initiative in the treating process and it is out of judicialcontrol.
