Research On The Protection Of Farmers’ Rights And Interests In Rural Land Transfer

In the process of development and reform about rural economic society, the farmers andgovernment centering on rural utilization problems have made several years’ exploration andpractice. The basic rural land institution has been reformed and innovated continuously. Ruralland transfer as an important part of basic rural institution prospers. However, many worryingproblems like farmers’ rights protection come into being in the practical operation of ruralland transfer.In the rural land transfer process, the general objective design of central governmentincluding total amount of cultivated land control, foodstuffs safety protection, development ofrural production and improvement of farmers’ is clear and definite. However, the objective ofthe local government is different from the central government and it leads to the loss ofcultivated land and damages of farmers’ rights and rights. Based on the analysis ofmechanism design theory, the result is caused by rural land transfer mechanism which isdesigned falsely. Current rural land transfer mechanism design can not satisfy the conditionslike Participation constraint, Incentive compatibility, regulation authority and it not onlycannot protect farmers’ rights and interests, but also protect foodstuff safety. The concreteperformance is listed below: farmers’ actual preference is blocked; the incentive mechanismof rural land transfer is not reasonable, unfair interests’ distribution leads to the deviation ofthe result and harm of farmers’ rights and interests about land transfer, and the constraintmechanism has problems like lack of administrative constraint and social constraint.In order to protect farmers’ rights and interests in the rural land transfer, the governmentshould establish the farmers’ rights and interests’ protection mechanism from three aspects.The first one is to improve the democratic decision-making mechanism about rural landtransfer and regulate government behaviors in rural land transfer decision-making so as toreveal the actual preference of the farmers. The second is to establish reasonable sharingmechanism about Value-added benefits of rural land transfer through the establishment ofmarket price formation mechanism in rural land transfer and the reform of value-addedinterest sharing mechanism so as to increase farmers’ value-added income and change theways that government gets benefits. The third one is to improve the institution constraint, administration constraint and social constraint in rural land transfer and regulate thegovernment’s benefit-seeking behavior and offence against law.
