The rate of domestic abuse happening in China is29.7%-35.7%. Most of its victims arefemales. However, due to the lack of proper legislation against domestic abuse and therestrain of certain Chinese traditional customs, victims are not likely to gain legal remedy, andthe abusers would likely become more violent because of improper punishment. This essaytends to analyze a typical domestic-abuse case happened in2009, then presents some viewstowards its qualitative analysis. Meanwhile, this easy would also make a study of the reasonresponding for domestic abuse and their respective preventive measures.The first part is the cause of action:the case of Wang Guangyu’s domestic abuse.The second part is the merits of introduction. Briefly introduces the basic situation ofWang Guangyu’s domestic abuse case.The third part is the focus of the controversy about this case. About what kind of crimeWang committed, experts and different persons hold different opinions: some are for theCourt’s conviction that Wang should be punished as domestic abuser. Some maintain thatWang should be punished under the Intentional Injury clause. Still, Some other think theabove-mentioned opinion are both partly right.The fourth part is an analysis of this controversy. Based on the four elements of a crime,it starts with an analysis of the above mentioned two crimes involved in this case, namelydomestic abuse and intentional injury. Then, this part makes a study of Wang’s behaviors, andcomes to the conclusion that Wang committed a crime of both domestic abuse and intentionalinjury.The fifth part makes a legal principle analysis of this defensive’s crime. Based on anintroduction of quantity of crime’s theory, this part makes a study of the defensive’s behavior.And the conclusion that both two crimes were committed is made at the end of this part.The sixth part is an extensive legal thinking about this case. Based on this case andcurrent situation in our country, this part answers the question about why such case happens atsuch a high rate and comes up with some solutions.
