The Emission Trading Scheme (ETS) which has been launched for decades ofyears and has a significant effect in controlling global warming and reducing airpollutions. European Union started ETS for aviation since Jan.1st2012. On the basisof ETS Derective2003/87/EC, EU carries out Derective2008/101/EC which speciallyprovides the rules of ETS for aviation. Since then, the industry of aviation has beenincluded into Emission Trading Scheme. According to EU Derective for aviation, allthe airplanes departing from or landing off the airports of EU members shall beincluded into ETS since Jan.1st2012. The EU will allocate allowances on the basis ofmonitoring results from past years, while any company exceeds the limit allowancewill buy more. Lately, the EU announced a list containing more than2,000airlines,the listed airlines will be included in the EU emissions trading system in2012.Among them,33chinese airlines are listed, including the three major aviationenterprises Air China, China Eastern Airlines, China Southern Airlines, as well as fivecargo airlines. They are distributed to10different EU member states for management.And that will produce great effects on the development of China’s aviation industry.Full text is divided into four parts, each paragragh is as follows:The first part is the basis of full text. This part analyzes the definition, the historyand therial basis of Emission Trading Scheme. And then the author discussesobjective, characteristics and influences of EU ETS especailly the aviation part. In theend, the interplay relationship between EU ETS for aviation and Kyoto Protocol hasbeen analyzed.Through textual analysis, the second part studies the text itself of the EU ETS foraviation. Under the Derective2008/101/EC, the article discusses the aim of emissionshall be reduced, the geograghic scope of trading, the division of admininstratingmember state, allocation method and monitoring method and so on. The third part applies legal analysis into the rules including aviation into EUETS. According to the provisions of Kyoto Protocol, the Chicago Convention andbasic principle of international law, the author wants to figure out whether the EU hasqualification to set rules for foreign planes, whether the provisions of the Derective2008/101/EC are in accordance with international law and the justice principle.The forth part locates in China, discussing the effects on China caused by the EUETS for aviation which include effect on chinese aviation industry and the wholeeconomy of China. After that a series of measures have been presented. Thesemeasures can be divided into domestic measures and international measures. Thedomestic part includes putting more into new technologies, developing clean powersto instead the old ones and building the Emission Trading Market of China. Theinternational ways are prosecuting before the national courts of EU member states orcalling WTO for help, but the two ways are risky.At last, the author gives a conclusion of the full text.
