Global warming has become a serious threat to human survival and the sustainable development of social economy. Limiting the emission of greenhouse gases and optimizing the earth environment has become one of the most important issues of the international community. A large number of scientific researches showed that the emission of greenhouse gases produced by the consuming of fossil fuels is the main reason of global warming. Under this background, the carbon trading system,which provides a low cost and high efficiency carbon emission reduction mechanism.As the first convention in controlling the emission of carbon dioxide and other greenhouse gases, the United Nations Framework Convention on Climate Change,since its entry into force 22 years ago, has laid a solid foundation of international law for the countries of the comprehensive control of greenhouse gas emissions and effective response to climate change launched international cooperation. EU emissions trading mechanism is currently the most widely used for reference in the world, which is the outcome in the operation of Kyoto Protocol, providing a learning reference blueprint for other countries. China as the largest developing country, strive to promote the Paris Agreement in Paris climate conference in 2015. China regard it as a responsibility to reached the peak in the carbon dioxide emissions before 2030,and will make all possible measures, including initiating carbon trading system comprehensively in 2017, to achieve this target as early as possible. Faced with such a difficult task, establishing our own carbon trading mechanism, improve the carbon trading system as soon as possible, so to regulate the behavior of carbon trading, are first steps in legal support.
