As the saying goes,“people are the basis of the country; food is the basis of human”.Therefore, Food safety is closely connected with the livelihood of human. Along with theestablishment of the new China, the development of reform and opening up, and the joiningof WTO, the dietary needs of the people in China are becoming more and more highly,gradually from subsistence to health. But what can not be ignored is that food safety hazardhas been emerged in endlessly, from Sudan red to Clenbuterol, from Sanlu milk powder todyeing bread, which marks the outbreak of China’s food safety crisis. Of course, there aremany reasons for the generation of the food safety hazards, but one of which is thatgovernment food safety regulation is not in place. Therefore, there are a variety of measuresto address food security crisis, one of which is to strengthen the responsibility of thegovernment of food safety regulation.There are many means for the government to regulate food safety, one of which is theprior establishment of food safety standards. As a kind of technical standards, food standardsare prior regulatory tools of the government to regulate the competition in the food industryand to avoid social risks. Food quality standards are the basis of national quality and technicalsupervision departments to crack down on fake food, which make effective supervision andmanagement of the food industry. The reason for food Standards to measure food qualityeligible or not is due to give full consideration on harmful and potentially unsafe factors offood in the formulation process of the food, and to stipulate the microbial indicators, thephysical and chemical indicators, test methods, shelf life, etc. to make sure the food meetingthe safety standard. Therefore, as one of the means of government regulation of food safety,food standards is one of the basis for judging the quality of food, and it is an important basisof enterprises to make scientific management and to improve competitiveness. The foodStandards is beneficial to reduce and avoid the emergence of the food safety problems ofchina, to protect the health and life safety of our nationals, to promote the continueddevelopment of the society and economy. Thus, in today’s society with frequent occurrence offood safety issues, the government, more and more enterprises, scholars and nationals beganto focus on the issue of food standards. This paper researches on current situation andcountermeasures of china’s food standards from the perspective of the Administrative law.Combining with the national conditions that China’s food standards formulated by the government-led, this paper analyzes the existing problems at the present stage of the foodstandard formulation, clarifies the foundation and feasible basis of the formulation of China’sfood standards, proposes countermeasures and suggestions to perfect the formulation ofChina’s food standards from the perspective of the foundation, feasible basis and adoptinginternational standards etc.This paper consists of four parts. The first part discusses the background of the article,that is the connotation of the formulation of China’s food standards in Administrative law,which including three parts, the concept and effect of the food standard,the connotation andthe legitimacy of that food standard formulated by government-led. The second part putsforward studied issues of this paper that is the overview of China’s food standards and theproblems at this stage of China’s food standards development. The third part analyzesproblems. Against the problems about China’s food standard formulation at this stage, thispaper describes the three issues that I think we should clarify about the food standardformulation, that is, whether the higher food standards developed, the better or not; what isthe basis of food standards formulation; whether the formulation of food standards shouldadopt international standards or not. The last part solves problem. This paper proposescountermeasures and suggestions to perfect the formulation of China’s food standards fromthree perspectives. For the formulation of China’s food standards, the most important is to bebased on risk assessment, make sure feasibility based on the findings, make appropriate use ofinternational standards, refer to foreign advanced standards, develop feasible and advancedfood standards, while playing a leading role of the government. As the same time, thegovernment should perfect the basis of the formulation and the process of formulation ofChina’s Food Standards. In addition, the formulation of China’s food standards should valuethe effect of professional Committees while play a leading role of the government.
