Analysis Of Right To Education Of Vagabond And Beggar Children

In recent years, the protection of rights of vulnerable groups of people are got more andmore concerns from people.Vagabond and beggar children are special vulnerable groups ofpeople,the protection of their rights has become the focus of attention in the glare ofpublicity.At present,although the government has adopted a series of measures to protect therights and interests of Vagabond and beggar children,the measures are mainly protected theirpersonal safety, life etc.Their individual development are received little effective protected,especially for right to education.Protecting the rights of receiving education has the extremelysignificance for their rights to subsistence and development.With the aid of the research methods of literature, empirical research,this paper mainlyanalyzes the present situation and difficulties on the right to education of Vagabond andbeggar children,and explores some specific safeguard measures and relevant laws andregulations.This paper is divided into four parts:Part one, this part analyzes the based theory on the right to education of Vagabond andbeggar children.The article defines what are Vagabond and beggar children,and states themeaning of right to education,including the concept,characteristics and significances.Legalprovisions of the right to education at home and abroad are also analyzed. Based on theanalysis,this paper analyzes the contents, characteristics and necessity on the right toeducation of Vagabond and beggar children.Part two,this part analyzes the current situation of the right to education of Vagabond andbeggar children.The main contents include the causes, current situation and guarantee of rightto education of Vagabond and beggar children.And the causes are mainly as follows:familypoverty,Vagabond and beggar children are controlled by lawbreakers,adverse effects on theeducation mode and home environment.Although the government has taken measures to helpthese children and Aid groups has given active assistance on the right to education ofVagabond and beggar children,current situation is not optimistic.Part three,this paper states the dilemmas of right to education of Vagabond and beggarchildren.The troubles include:lack of legal foundation,imperfection on existing supportingsystem,negligence of guardian’s duties,social support and government duties. Part four,this part are mainly regarding to perfection of the security system of the right toeducation of Vagabond and beggar children.We must ensure security principles firstly andestablish relevant laws and regulations and compulsory relief system.the government shouldperform duties and enforce the law.This paper focuses on the exploration on the mode ofeducation of Vagabond and beggar children.These beneficial exploration mainly includes:theimplementation of new-style social security system on the right to education on the aid ofrelief stations,setting up schools in the community for Vagabond and beggar children, thefoundation of volunteer stations.
