Research On Expert Asistant Systerm In Criminal Lawsuit

With the development of technology and the progress of society, there are more andmore specific problems in modern litigation, to solve these cases efficiently and accurately,the help of people with specialized knowledge has become a worldwide trend in the judicialactivities. In our country’s criminal activities, it is difficult for judicial identification system toovercome its own weakness; it is a necessity to establish the expert assistant system. The rulesof the expert assistant system in the newly revised Criminal procedure law are too simple tooperate. We have to look into the Expert witness system of England and America, and theTechnical consultant system of Italia, so as to connect expert assistant system with judicialidentification system except the introduction, this article can be divided into three parts withabout30thousand words.Introduction: in this part, we analysis the necessity of the help of expert assistants fromthe aspects of social development and the lack of sufficient knowledge of special issues of thejudges. From the aspects of the weakness of judicial identification system and the safeguardof right of cross-examination of experts’ conclusion, we discuss the need of experts getinvolved into criminal lawsuit activities.Part one: in this part we mean to discuss the development of the expert assistant systemand its great importance.it is first been seen in the “certain rules on civil litigation evidence ofthe supreme court, and then “certain rules on civil litigation evidence of the supreme court,and now in our Criminal procedure law. Which is not only helpful to realize the value ofjustice and efficiency, but also helpful to perfect the judicial identification system.Part two: the simpler the rules are, the harder it operates, so we have to learn from theExpert witness system of England and America, and the Technical consultant system of Italia,which helps the application of expert assistants system in qualification, selection, theworkability and rights and obligations.Part three: this is the most important part of this article, after we have learnt from theExpert witness system of England and America, and the Technical consultant system of Italia,with the practice of Xiamen and Sichuan court, we discuss the application of expert assistantssystem in the qualification of experts, who and when to hire experts, rights and obligations of experts, and what responsibilities should they take if they break the rules.
