Research On Local Environmental Legislation In Hunan Province Since1978

Local environmental legislation is an important part of the socialist legal system with Chinese characteristics. With the increasingly serious of the environmental problems and gradually awakening of environmental consciousness, local legislation has been more and more important in Chinese legal system. Since1978, environmental legislation in Hunan Province has made great achievements, abolished a great deal of regulations which are made under the guideline of "anthropocentrism" and recalibrated series of provincial-level environmental protection regulations, these regulations have played an important role in promoting Hunan economic and social development, standardizing environmental behavior and preventing and controlling environmental pollution and so on.On the legal basis of the Hunan Environmental Protection Regulation, Hunan environmental legislation embrace its legislation on the core value target of land greening, ecological maintain and resource conservation, comprehensively developed the environmental protection on the basis of strengthen regional environmental construction achievements, has carried on the comprehensive specifications in environmental protection, forest protection, water and soil conservation in Hunan, the development of land and resources protection, channel management, forest park management, management of mineral resources, scenic area management, prevention and control of atmospheric pollution, protect wildlife resources, geological environment protection and wetland protection, the protection of green heart of Changsha-Zhuzhou-Xiangtan City Cluster, established that environmental protection is a green screen to improve provincial economic cycle development and people’s security in production and living and realize the sustainable development of provincial environmental protection industry.Under the circumstances of the construction of beautiful China and the eco-civilization system, we discovered that the idea of Hunan’s environmental legislation has not fully transformed from anthropocentrism to ecological holism when examine the environmental legislation achievements in the perspective of sustainable development and ecological holism in Hunan province and carding environmental legislation development in Hunan province since1978. Under the guidance of ecological holism, there are unclear environmental legislation guiding ideology, unscientific of the environmental legislation system, ill-formed of environmental legislation language and lack of environmental law enforcement supervision mechanism which based on the specific content of environmental legislation provisions of Hunan province, the research on Hunan province environmental laws in terms of the rights and obligations, the proviso clauses, supervision, liability clause. Through comparative analysis of the Ruhr area in Germany, the Australian state of Victoria, Massachusetts, energy and resources legislation in Shanxi province, water resources legislation in Hubei province and the prevention and control of air pollution in Guangdong province, found out that Hunan environmental legislation should perfect environmental legislation guiding ideology, complete environmental legislation system, supplement the environmental legislation language and improve the distribution of environmental law enforcement, etc.
