The Truth Obligations Of Parties In Civil Proceduresand Its Legal Consequences

Article13of “Civil Procedural Law” recently modified has incorporate the principleof good faith, which signifies a great advance for China’s civil procedure law. Theprinciple of good faith, generally, is the legislation guidance of truthfulness obligation;hence, the discussion on truthfulness obligation and legal consequences of parties to civilprocedures under such background has a particular and realistic significance. This paper,initiating from the theoretical basis of truthfulness obligation, analyzes the evolution aswell as the connotation, content and value of truthfulness obligation, thereby exploring themain representation of truthfulness obligation and the legal consequences in both civil lawand public law arising out of breach of such obligation. It finally discusses the necessityand legislative construction in establishing truthfulness obligation. The author seeks toperform systematic analysis truthfulness obligation of parties to civil procedures and itslegal consequences, while his investigation in the establishment of truthfulness obligationsystem offers guidance to China’s juridical practice.
