Study On The Crime Of Illegal Procuring Citizens’ Personal Information

The second paragraph of Article253of the Criminal Law defined the crime ofillegally procuring citizens’ personal information. This is a milestone in our country onthe protection of personal information in the legal process, but there are many difficultiesin the judicial practice. The main reasons are the uncertainty of the concept of the personalinformation, the controversy of the illegal means and the ambiguity of the serious cases.This article is to make the analysis and discussion one by one, in order to come toreasonable suggestions. This article use identification and generalization combined withothers’ opinions to come to the definitions. On illegal means, this article is to focus on thevarious types of methods. In serious cases, the discussion will begin with the behavior ofthe plot, the object of the plot and the consequences of the plot, and use the specificcriteria and combination criteria to come to the conclusion.
