| With the coming of twenty-first century,the rapid development of information technology brings convenience to people by helping spreading personal information of citizens more easily,but it affects personal information security of citizens because it is a threat to citizens' personal and property security as well.Therefore,the protection of citizens' personal information,especially the protection by criminal law,becomes a key topic in the theory and practice field.This paper mainly includes:The first part: the concept of citizens' personal information.Starting from different appellations of personal information of citizens,this part gives a statistical analysis of cognizance situation of criminal judicial practice in the courts in every province and municipality,meanwhile identifies,classifies and summarizes specific information category of personal information of citizens one by one.Based on the foregoing contents,this part also introduces different opinions of legal attributes of personal information of citizens and at the same time,discusses different understandings of the concept of specific personal information in order to clarify the meaning of personal information of citizens further.The second part: emphasis on cognizance situation of behaviors.This part discusses different opinions of illegal sale or providing of personal information of citizens and analyzes the cognizance situation of violation of relevant provisions of the state.There is a deep discussion of stealing and getting by other means as well as cognizance situation of illegal behavior.The third part: emphasis on cognizance situation of serious case.Through the analysis of the theoretical disputes and practical problems over the phrase serious case,this part indicated that it is urgent to define what is a serious case.This part also gives a statistical analysis of the standard of general considerations in serious case and the latest judicial interpretation of the provision serious case. |
