Study On Legal Protection Of Environmental Right To Know

With the rapid development of social economy, environmental pollution is becoming more and more seriously, During the Spring Festival, the fog and haze weather has emerged all over the country. In the New Year’s eve, Jinan, Nanjing, xi’an, and many other cities also encountered "burst table". Last year, China encountered several large range of fog and haze weather, the worst affected17provinces throughout the country. Environmental issues once again aroused people’s great attention. As early as in the middle of the20th century, due to the worldwide ecological deteriorating, as well as increasing environmental damage incidents, citizen’s environmental rights ready to come out and get continuous development and established internationally, At the same time, the concept of people’s sovereignty in the world improved gradually, the right to know as a fundamental right of citizens has been established. Environmental rights and the right to know interacting with each other in the combination process, it is also the process of the right of environmental information developing and improving continuously. Western countries and the international community’s right of environmental information has developed rapidly and improved continuously, however, the development of Chinese law in this respect is relatively lagging behind. We have not yet established environmental information system on legal level. The exploration and research of environmental right to know, we have made a lot of achievements. Along with our country the environmental right to know and citizens’ right to know theoretical exploration deepening and legislation evolving. There is an urgent need of the environmental right to know us improving constantly in the legislation and practice, so it would offer help in the establishment and development of China’s environmental information system on the legal level.In this article, I started from the basic theoretical issues of environmental right to know, in combination with the current situation of legal protection of China’s environmental right to know and use for reference the experience of legal protection of the environmental right to know in other countries, I made a comprehensive review in legal protection of environmental right to know in China and a comprehensive analysis on how to further perfect legal protection in our environmental right to know. This paper is divided into six parts to discuss the legal protection of the environmental right to know in our country. Chapter one is the introduction, introducing the background and origin of the legal protection of environmental right to know, also discussing the constitutional significance and practical function of legal protection of environmental right to know in modern society. Chapter two is the core issue of the legal protection of the environmental right to know, this chapter began with an overview of environmental rights, the right to know and environmental right to know, then expounded the basic theory of the environmental right to know from the subject, object and content, finally discussed a few basic principles of the environmental right to know. Chapter three discussed the current situation of legal protection of the environmental right to know in China, unfolding mainly from two aspects:legislation and local practice. Chapter four is the development trend of extraterritorial laws to legal protection of the environmental right to know and the inspiration and reference to China, mainly introduced the current situation of legal protection of the environmental right to know in the international and regional organizations’ and several typical nations, and then expounded the enlightenment and reference to our country. Chapter five mainly discussed the bottleneck existed in the legal protection of current environmental right to know in our country. Chapter six combined the full text explores the improvement of legal protection of environmental right to know in our country, firstly I analyzed the feasibility, and then put forward several suggestions and countermeasures in the improvement of legal protection of the environmental right to know.
