Informed consent right is one of the most basic rights of subjects. in clinical trials, during practice, the case of informed consent right of the subjects infringement occurs very frequently, the existing laws and regulations in China have been unable to meet the need of protection on the right of informed consent, which promote to improve the analysis of the problem of the informed consent in order to achieve the purpose of protecting the subjects’ informed consent right. In this paper, after describing the source and content of informed consent right, I analyzed the subjects facing problem and reason of informed consent right in clinical trials. On this basis, learning from the foreign advanced experience, and making perfect suggestions and find out the ways by practicing, building a set of laws and regulations system to protect the informed consent right of subjects, making the right of informed consent be effectively implemented in the field of clinical trials achieving the desired effects of protecting the informed consent right of subjects finally.
