Fertility phenomenon is just as human beings, existing for an extensive and long time. Whether for the individual or for the whole society,the importance of fertility is self-evident. Seeing from the whole process of human history, we can roughly summarized the development phase of reproductive system as three stages:Stage of natural fertility, stage of fertility obligation and stage of reproductive rights. After the development of the three stages, the fertility phenomenon has achieve a final conversion, changing from the obligation to rights.In the1960s,the world began to recognize and protect the reproductive rights.As the dispute of reproductive rights increasing,the academia gradually began Systematic discussion reproductive rights. Scroll the literature associated with reproductive rights, the authors found that,many of which are about the nature of reproductive rights, reproductive right of couple’s infringement,and relief,and some other issues. Some of them are researches on reproductive rights of special groups, this part of the main discussion is whether the sentence criminals can enjoy reproductive rights.But studies of reproductive rights on the special group of AIDS patients are few.Although the protection of human rights of people with AIDS has gain increasing attention of the international community and AIDS organizations,and there are many international human rights instruments also made provisions to protect the rights of people with AIDS, such as the right to health,the right to privacy, marriage and reproductive rights, and other major human rights were defined. However, in reality, there is considerable controversy about whether people with AIDS should enjoy this reproductive rights. What is more,the academia and the legal profession have no authority findings and clearly consistent law about this issue.We all know that fertility is the form of the human race stretches, reproductive rights is an important part of reproductive system. Thus,as a fundamental human right,reproductive rights should be guaranteed. Moreover, as a special group, the protection of AIDS patients means great significance to the protection of socially vulnerable groups in law,the development of social order and,and the development of human rights cause,an so on. In addition, the protection of the interests of people with AIDS will make great contribution to defeat AIDS. Therefore,researches on the reproductive rights of people with AIDS are necessary. For this reason, the article will be divided into four parts to study this issue.Hoping that it can have a certain role in protecting the interests of people with AIDS The first part, an overview of AIDS and reproductive rights.This section mainly described the concepts and status of AIDS, and the meaning and the nature of reproductive rights,which makes us have a more comprehensive and systematic understand on AIDS and reproductive rights. At the same time,this part introduced the current situation of reproductive rights of people with AIDS,so we can clearly recognize that the current situation of AIDS fertility.The second part is about the reproductive rights status of people with AIDS, it explores the wishes of people with AIDS and the obstacles to reproductive rights status of people with AIDS and causes.The third part describes the necessity and feasibility of having productive rights. Discussion on the necessity is mainly from the need of human rights, require of family and social harmony, the concept of public responsibility,the demand of rights and obligations of reciprocity, the idea of public responsibility, the principle of equality and justice.The fourth part explores the protection and realization of restrictions on people with AIDS.This essay tried to Seek solutions improve the program from the following four areas,:the individual level,the social level, the level of medical technology and legislative level.
