The Basic Theory About The Socialistic Legal System With Chinese Characteristics

Under the leadership of the Communist Party of China, the legal system in2010Chinese socialist has been formed on schedule with various efforts. It is the milepostof legal system building in China. But it is just the beginning of our legal road. Toimprove the quality of the legal system, we need to analysis the theoretical foundationof the socialist legal system with China characteristics in depth, as our legal system isnot perfect. With this study, I hope to provide some useful theoretical consultation ofthe development and improvement of China characteristics to the socialist legalsystem. This paper is divided into four parts:The first part mainly discusses the connotation of the socialist legal system withChina characteristics. Define Chinese socialist legal system from the following fouraspects: the proposed and formation of the socialist legal system with Chinacharacteristics; the formation of the socialist legal system with China characteristics;the nature of the socialist legal system with China characteristics; the characteristic ofsocialist legal system with China characteristics.The second part analyzes the ideologically sources of the Chinese socialist legalsystem. Mainly expounds the effect of Chinese excellent traditional legal culture andthe outstanding achievement of western legal civilization to the construction of thesocialist legal system with China characteristics.The third part grubs deeply the theory origin of China socialist legal system. Itmainly argues that Marx, Engels, Lenin about the legal system thought, the Chinesesocialist legal system and their contribution.The fourth part summarizes theoretical basis of Chinese socialist legal system..It Mainly discusses the important contribution on legal system with Chinacharacteristics of Mao Zedong’s, Deng Xiaoping’s, Jiang Zemin’s and Hu Jintao’slegislative thought.
