Pending Custody Rights Protection Research

In China, pretrial detention is an important part of the system of criminal compulsorymeasures. In criminal proceedings, the rights of detainee are most vulnerable violated bythe goverment, which need be drawed more attention and protections, and requires us topresent pretrial custody system of rational thinking, combined with the status quo pendingto guarantee the rights of detainees, to gradually transform and continuously improve theprotection of human rights. This paper is divided into four parts:Several basic questions about the pending custody rights will be discussed in the firstpart of main explanation. A simple analysis of several basic concepts, such as the custody,pending custody, pending custody, clarifies the legitimacy of the pending custody rights.And the rights of the content are summarized.The second part mainly studied the ancient Chinese and foreign protection systemsand main measures of pretrial detainees rights, through vertical and horizontal comparison,for a better understanding of the pending custody and protection of the rights of humanlife.The third part not only fully affirms the progress and achievements of China in thepretrial detainee rights, but also points out some problems existing in the legislation and inpractice.The fourth part based on the above discussion, put forward some suggestions toperfect the protection system of pretrial detainees rights.
