| Since the implementation of the strategy of "Going outside" for almost20years,China has been transforming into a capital-exported country from a capital-importedone, which is definitely a enormous event. Investing abroad is a important strategy forChinese foreign economic development, which needs to cope with various risks,especially the legal risks during investment overseas. From the perspective ofinternational law, studying and analyzing on how to response to such risks shall bevery important and necessary.This thesis consists of the following aspects:The first part explains the research background and research status at home andabroad, and put forward the research ideas of the paper.The second part is from the point of view of the current domestic legal system ofChina overseas investment, divide overseas investment of domestic regulation into theapproval stage, operation stage and exit stage. It analysis related problems of legalsupervision system in china, through the deep understanding of Chinese domesticlaws and regulations on overseas investment stipulation.The third part the international protection system of overseas investment, mainlyfrom two aspects of bilateral and multilateral agreements, then simply introduces therelevant provisions on overseas investment, and clarifies some thinking and analysisof the bilateral and multilateral agreements.The fourth part mainly discusses the risk prevention mechanism of the overseasinvestment of Chinese investors. Firstly, we clarify the general concept of risk, andthe business and non business risk may face in overseas investment, and then providesome feasible suggestions to optimize the risk prevention mechanism of Chinaoverseas investment in next step. We analysis the different measures of risks that maybe encountered in the current overseas investment from both the government and Chinese investor’s point of view. And then puts forward some problems existingin current overseas investment risk prevention mechanism. |
