With the development of China’s economy and the improvement ofpeople’s living standard, more and road infrastructure construction inour country is more perfect, more volume of cars, which is convenient forpeople to travel. However, emerge in an endless stream all kinds ofdangerous driving behavior, a serious threat to the safety of people’slife and property. The amendments to the criminal law eight drunk drivinginto the punishment, which embodies the criminal law to keep pace withthe times, however, poison is driven not incorporated into the scope ofregulation of punishment. Theoretical research and practice prove, socialharmfulness of drug driving than drunk driving go beyond. In recent years,drug driving caused traffic accidents, which do serious harm to the roadtraffic safety and the safety of people’s life and property. In view ofthis, drug driving attracted the attention of the relevant departmentsand the broad masses of the people concerned, poison driving into thepunishment of rising. At present, the direct provision to this in ourcriminal law is still blank, but in the other countries of the world,criminal law on drug driving made relevant regulations. This paper firstlyintroduces the related knowledge of drugs and harm to human and socialharm, and analysis of drug driving in traffic safety field, then analyzedthe present situation of our country at the present stage in high incidenceof poison; toxic driving into the punishment has many useful local,domestic, drunk driving into a series of activities and content punishment,and many other countries and regions, practices, and then combined withthe drug driving their own characteristics and the specific nationalconditions of China drug driving into the related problems of punishmentare discussed.
