A Study On The Forming Mechanism Of Trust Law

Our nation is now in the stage of striving to build a socialist country under the rule oflaw, so it is necessary to establish corresponding legal system. In the meanwhile, publicheartfelt trust on the law becomes particularly important. However, the present situation oflaw faith in our nation is quite worrying, thus how should we improve the citizens’ faith inthe law? This paper first expounds China’s current law faith status and existing problems.Through comparison, historical analysis and other research methods, based on the researchupon the formation mechanism of foreign legal trust, enlightenment on legal trustmechanism in our country will be gained and thus some ideas of perfecting our country’slaw trust mechanism is expected to given.The paper is divided into three parts. The first chapter mainly introduces the currentsituation of law trust in our country, tradition of lacking faith in law, the disconnectionwith law value, certain obstacles in the operation of law, law education insufficient lawdissemination and related series of problems. In Chapter II, by virtue of comparative studyof law trust formation mechanism among the countries Britain, the United States,Singapore, Germany, and France, what we can learn for our China is good life foundation,legal tradition culture and harsh punishment are indispensable to win people’s trust in thelaw. The third chapter proposes that to perfect legal trust formation mechanism in ourcountry requires gradually developing a good legal culture, improving life basis of peoplein China, establishing justice law, struggling for reducing the blocking in law operation,and strengthening law education and dissemination of law, so that public trust on the law inour country could be raised.Lots of points about law faith still remain to be studied. This article just gives ananalysis from the perspective of legal trust mechanism. And the main innovation of thethesis is to perfect the trust in the law of our people in China based on the angle of the lawtrust mechanism. Additionally, general rules are sum up from the comparison of law trustformation mechanism of several countries and applied into law trust formation mechanismof our nation. To study the law trust from the perspective of formation mechanismprovides some ideas and approaches for perfecting law faith in our country. Moreover, thisstudy follows the steps of narrating current situation, explaining the existing issues,analyzing foreign law trust mechanism and giving some creation, which help to find outthe essence through the phenomenon and eventually address the problem both fromthe symptoms and root causes.
