Research On Rural Land Expropriation Compensation Standards

Land is the foundation of the farmers. In planned economy period of China, industrial and agricultural product price scissors make farmers to pay a high price. After the reform and opening-up policy, for the development of urban economy, the government spends very little compensation to expropriate rural land, farmers are in the bigger exploitation. With the acceleration of urbanization and the increasing demand of land, a large number of farmers lost their most important means of production and life insurance in the process of land expropriation. However, the compensation is evidently not enough to sustain farmers’lives after they lost land, inadequate compensation make the farmers to feel very angry, a large number of petitions has happened because they couldn’t find any useful help, and even many violence extreme events has happened too. Contradictions are increasing between the government and farmers. Defects of our current rural land expropriation compensation standards, in fact, already become the one of factors restricting the new rural construction and the harmonious development between urban and rural areas. The author try to base on this social phenomenon, combined with the general theory of land expropriation compensation standards, analyze the problems existing in the rural land expropriation compensation standards in our country, and put forward corresponding countermeasures. Besides preface and epilogue, this article is mainly divided into four parts to unfold.The first part:firstly, by mentioned the Hunan’s case which is about villagers’ lawsuit against government because of dissatisfaction with the expropriation compensation, the author supposes that the current land expropriation compensation standards should have some problems, then elaborate these problems through six parts.The second part:talk about the land expropriation compensation standards’general theory with different principles of compensation and the value composition of land expropriation compensation.The third part:based on the historical tradition, the functions of the government and the property right system, explore the causes of the current problems. The fourth part:according to the mentioned problems, propose specific measures to improve our country’s rural land expropriation compensation standards..
