Study Of Land Requisition Compensation Standards

Land expropriation is the administrative action that the governments in all of world obtain other civil man's land in force for public interests. In China it is the administrative action that the government transform collective lands into national ones. Because the system of land expropriation comes into being in the period of planned economy, many problems are occurred in the process of the land expropriation. But at present, the system of land expropriation doesn't change when many conditions have been changed so that many farmers appeal to the higher authorities for help. It is necessary to study deeply on the system of land expropriation to help governments to make a requisition for land successfully, to keep the society stable and united, and to improve the development of our economy.Based on the theories of Marx land rent and price, land market, land expropriation compensation, problems of land expropriation have been deeply invested. Studied from our present compensation standard for land expropriation, difference systems of land expropriation between our country and other countries have been analyzed. Results show that great shortages exist in our systems of land expropriation. The author in this paper think that the compensation standard for land expropriation does not satisfied our economy development and it is not scientific to depend on output value times. Land expropriation should be compensated according to market price. Land expropriation price should be assessed land quality, regional position, the relations of land supply and demand. Decision of compensation standard for land expropriation should be adapted to local condition. Method of difference assessment should be adapted in difference situation.Studies show that: 1) Focus of conflicts between nation and farmers, constructions and farmers is compensation standard for land expropriation; 2) The compensation standard for land expropriation is too low to not adapted economy development; 3) Land expropriation should be compensated according to market price; 4) The assessment method of compensation standard for expropriated land expropriation should be based on the market value of the land in suburban of city; 5) The assessment method of compensation standard for land expropriation should be based on output value times remote suburban of city; 6) There is a long way to go for the problems of land expropriation .
