Research On Legal Countermeasures Of Transnational Cybercrimes Against Property

The influence of cybercrimes against property is so deep, not only is a threat tothe legitimate rights of property to individuals, enterprises or other organizations, butalso because the invasion and destruction of the computer system can destroy theindividuals and the enterprises’ daily life and even the society’s operation. Especiallyin recent years, frequently transnational cybercrimes against property to the countriesand regions of the world and put forward many new challenges, the importance ofnetwork security is increased to a new level.To solve these problems is not only the power inside one country can achieve,but needs more countries’ cooperation, and the need to remind the country which notinvolved in, is combined with the needs of the international community. This paperbased on the high-tech crime like the cybercrimes against property, and the changesthat existing domestic and international legal system, put forward some legal adviceon the cybercrimes against property and countermeasure and method to the emergingchallenges. This paper is consists of three parts: the first part is the summary of basicintroduction of cybercrime against property. Start with introduced the conception andclassification of the network property, specially the virtual property. Followed byanalyzed the description and classification and characteristics of the cybercrimesagainst property. Finally I introduced several common types of cybercrimes againstproperty. The second part is about the international legislation of cybercrimes againstproperty. The legislation of cybercrimes against property including, the Convention ofinternational organizations, domestic law in some foreign countries, the legalprovisions of our country in Hong Kong and Taiwan and Macaw, and makes acomparative analysis between Chinese law and foreign law. The third part, improvesthe law of cybercrime against property. The various proposals put forward from thetheory of criminal law and legislation, and put forward the prospect of global cooperation and other method.
