Studies Of Small Consumers’ Rights And Interests Protection

With the development of the socialist market economy and the sound of the socialist legal system, the protection of consumers’rights and interests in daily small consumption is increasingly brought to the attention of the society from all walks of life, this article mainly aimed at the protection of small consumers’rights and interests. In a wide variety of consumption, the small consumption is the biggest part, which has the greatest impact on the ordinary people’s real life. The occurrence of a large number of small consumption disputes and the difficulty to resolve disputes actually make both consumers and countries realize that more attention is needed and various systems should be further improved in this aspect. At present, the substantive law and procedural law of consumers’rights and interests protection in our country lack special protection for small consumers, which is embodied in the following aspects: ways of safeguarding rights lack pertinence, punitive damages standard is not worth the candle,the procedural law lacks specific provisions for small consumption disputes. Therefore, the protection of the consumers’rights and interests in small consumption disputes is facing severe situation.Referring to other countries’ and regions’ experience of small consumers’ rights and interests protection system, this article improves the protection of consumers’rights and interests in small consumption disputes in our country through the following measures:Firstly, to consummate substantive law and procedural law of the consumers’rights and interests protection, to make more specific and clear rules against the Rights and litigation of small consumers’ rights so as to increase the actual maneuverability of small consumption protection,thus make it have the law to obey; Secondly, to improve consumer association’s and industry association’s role in the protection of small consumers’rights and interests, thus achieve the protection of small consumers’legal rights and interests on many aspects; and to improve and perfect small consumption arbitration system and strengthen the government’s support for the protection of small consumers’rights and interests, establish the arbitration system adapted to small consumption disputes, and strengthen the government administrative enforcement and financial support. Anyhow more perfect protection system should be provided for the legitimate rights and interests of small consumers, from many aspects, combined with the real conditions.
