An Analysis Of The Legislation Pattern Of Natural Protected Area In China

At present, the situation of the China’s Protected areas deteriorated sharply. It is not only the destruction of the natural environment, but also a major threat to the survival of mankind. Drafting the effective Protected areas legal system, is not only an important measure to protect natural resources and biodiversity, but also an important manifestation of the Ruling the country by law. Legal system is the important foundation and the strong support of the construction and management of Protected areas, scientific legislation is its proper connotation. This paper describes the present situation of China’s natural protected areas legislation and summarizes their characteristics through the relevant literatures, specific case studies and other methods. China’s current legislative pattern of sector legislation with the relevant provisions has many defects, such as low-level, uncoordinated legal system, overlapping management and so on.Based on the problems of the protected area legislation, combining on the status quo of the effective management and the legislation, drawing on the good practices of international typical country, put forward a view of drafting comprehensive upper law eventually. To form a comprehensive legislative framework model for the management of Protected areas, and propose the basic idea about the comprehensive legislation.
