Flight attendant, as an independent profession, its existence has a long history.In recent years, with the development of civil aviation, the team is also growing,protection of flight attendant’s personal rights is also encountered unprecedentedchallenges, and the personal right of the flight attendant during work was violatedfrequently. Therefore, to emphasize on the rule of law within the framework of thisspecial group of "flight attendant" legal system of personal rights protection isnecessary.In this thesis, the content is divided into five chapters to explain the plight of thepersonal rights protection flight attendant and the way to explore.The first chapter is the introduction part, mainly stated that the origins of thiswriting, the main research methods, main ideas and the basic content as well as theinnovation and deficiency of this article.The second chapter in this paper, focusing on the basic theory of protection offlight attendant’s personal rights, mainly clarifying the formation and development ofthe concept of flight attendant, meantime, the particularity of personal rights and thepossibility of protection of the flight attendant have been discussed..The third chapter analyzes the plight of protection of flight attendant’s personalrights in China, on the basis of the current situation of protection of flight attendant’spersonal rights in our country, the plight and causes of the protection of flightattendant’s personal rights in China are analyzed. Of the legal system of our country,existing resources about the flight attendant special provision, almost to the personalrights of the personal rights protection and general terms and conditions also because ofits fuzzy and loopholes for flight attendants to provide a strong protection. At the sametime, the airline’s dominance and neglect of flight attendant personal rights, and has notbeen a flight attendant rights to protect themselves rights consciousness, caused thedifficulties of protection of the air cabin crew rights. To resolve the realistic problems,scientific and reasonable understanding of the characteristics of the flight attendant andthe special features is the foundation of personal rights of the flight attendantconstruction.The fourth chapter focuses on the domestic and foreign comparative study on theflight attendant human rights protections, on the basis of the Anglo-American law system and continental law system of flight attendant contrast and analysis of personalrights protection system, extracting enlightenment to flight attendant personal rightsprotection in China: to build excellent corporate culture, restrict dispatchingemployment proportion, in order to protect the legitimate rights and interests of flightattendant. Anyhow, examine the foreign relevant flight attendant of personal rightsprotection system, which directly or indirectly reflect the emphasis on employee rights,are good references for the guarantee of personal rights.The fifth chapter puts forward the concrete way of flight attendant personal rightsprotection in China, from the basic types of existing legislative mode and flightattendant personal rights protection in China’s legislative mode selection, analysis ofrespective advantages and disadvantages of dispersible type legislative model andlegislative model, considering the factors such as the legislation cost, convenient, pointsout that the comprehensive legislative model is the rational choice of flight attendantrights legislation, and points out the specific measures for flight attendant personalrights protection and industry protection mechanism in China.Taking all these into consideration, on the basis of the aspect of value, therealization of personal rights of flight attendant is rooted in the realization of the valueof the rights of the “people” itself, along with the order and the function of the safetyvalue. As we all know, the realization of the flight attendant’s personal rights issignificant, that is to say, the rights of this special group aircraft cabin can be realized,and we as common people, our personal rights will be realized, too. Thus we cangenerate the rule of law society.
