Legal Analysis Of The Elderly Spiritual Support

As the top one population of elderly people in the world, the problemof aging becomes worse and worse in China. With the rapid development of society andeconomy booming, the problem of material support was mainly solved. The promulgateof the newly modified of ‘The Protection of Old People’s Rights’ makes people focus onthe provisions on “Spiritual Consolation”. People are constantly throwing up moralproblems such as whether or not “Come Back Home Often” can be included in thelegal regulation, if it can be in the legal regulation, where is legitimacy basis, feasibilityand how to carry out practical problems. The topic of this paper has theoretical andpractical significance at this level. This paper draws on the experience from manyexperts and professors’ suggestions, the essence of ancient traditions of China andforeign advanced system, combining with national condition of China to analyze andresearch the elderly spiritual support of China.The text of this paper is divided into four parts:The first part is the basic understanding of spiritual support. The author systematicsummarized the concept of spiritual support, characteristics and legitimacy in order toget an overall understanding and grasp of the spiritual support’s nature. Part one settledthe theoretical foundation of the full text.The second part is the realistic problems of the elderly people’s spiritual support andrelevant analysis of the causes. In this part, the author first proposed the presentsituation of the elderly spiritual support and listed all kinds of problem, analyzed thereasons of these corresponding problems. All those set up the foundations for the fourthpart. The third part is the regulation and reference of spiritual support in ancient Chinaand overseas. In part three, the author researched the history of the spiritual supportsystem in China and the provisions of the foreign system of spiritual support,systemized and contrasted them crosswise and vertically, and then concluded theinspiration from legislation, judicature and society to help perfecting the currentspiritual support mechanism in China.The last part is the legal thinking of the relief of spiritual support. In this part, theauthor focused on how to improve the elderly spiritual support mechanism in China,and he/she did the best thing to present some suggestions and measures from threedimensions which are legislation, judicature and society. This part is where real value ofoverall text is realized.This paper attempts from the empirical analysis, lengthwise and crosswisecomparison, system construction and other multiple perspectives to explore the validityand feasibility of the legislation of the elderly spiritual support in China, and finallyformed a comprehensive system idea which in order to promote the development of thecourse of elderly people in China.
