The Court From The Perspective Of The Sentencing Suggestion

The last century90’s，China’s grassroots procurator ate specificationbased considerations of judicial discretion, and began to explore the reform ofsentencing recommendations. Through the accumulation of practicalexperience, the sentencing suggestion system increasingly perfect, in2010with the judicial interpretation of the effectiveness of the relevant documentsissued, shows that the sentencing proposal has to be established in our countrylaw. The sentencing recommendation systems become an integral part of thesentencing process, as a reference to the Court’s sentencing decision, it isimportant to the judges for the norms of discretion, and strengthen sentencingprocess confrontational, sentencing judges to improve the openness, fairnessand credibility. However, in the lower courts, sentencing recommendationexposes the limitations and difficulties of its existence in the simplifiedprocedure cases, not guilty plea proceedings cases and crimes committed, toboot onto the sound track sentencing recommendation, sentencing mustpromote the accuracy of information and completeness; strengthen sentencingdefense; Interaction between sentencing and sentencing.
