The Research On Formulating University Statutes From The Perspective Of University Management By Law

The strategy of managing university by law is the realization of the strategy of ruling the country by law in the field of higher education, which is significant both in theory and practice.The significance of university statues in managing university by law lies in several aspects. Firstly, the fundamental law will guarantee a university, based on its specific organizational properties, to follow the law of higher education and fully play its role in talent cultivating, scientific research, social service and cultural innovation. Secondly, following the fundamental law, university spirit and university culture should be built so that the practice of study pursuit by scholars and university management by professors is carried out, and academic freedom and ideal education encouraged as well. Thirdly, the fundamental law will enhance systematic introspection and cultural consciousness, guiding the university’s internal comprehensive reform and promoting modern university system.Four major issues are discussed in the dissertation, namely, what is university, what are university statues, what should be university statues, and the current situation of university statues in our country and the improvement of them. To make the study specific, university statues mentioned in the dissertation refer to those of public universities in Mainland China.Through such ways of documental retrieval, field investigation, expert interviews and comparison, some suggestions for the improvement of university statues in our country are put forward, including:(1) cultivating university culture and developing education belief and legal awareness;(2) extending decision-making bodies and enhancing participation of stakeholders;(3) perfecting formulation procedures and promoting the legal position of university statues;(4) optimizing the contents of the statues and emphasizing the arrangement of important systems; and (5) creating a favorable environment for formulating the statues.
