"Private copying" problem is subtle and complex. It has increasingly highlighted with theprogress of copying technology. It has great practical significance because it involves the coretheory of copyright and almost touches all the systems of copyright law. Under the currentnetwork environment, increasingly common private copying damages the interests of thecopyright owner seriously that its rationality has been subjected to unprecedented challenge.How to balance the interest relationship between copyright owner and social public undernetwork environment on the premise of protecting the freedom of private copying isbecoming the focus and hotspot which the copyright law scholars discuss recently.This paper is divided into five parts, the main contents include:The first part: Introductions. This part introduces the background and research status inthe current theoretical circle of private copying problem under network environment.The second part: It describes the general theory of private copying. In the first place, itanalyzes what is network environment, then defines the concept and features of privatecopying. Finally, it discusses the controversy of private copying and the reason of every viewthat both sides hold.The third part: It repositions private copying under network environment by establishingthe standard system of private copying. Then this paper puts forward the problem that how tosolve the crisis which brought to the copyright system by private copying under networkenvironment. This part is the core of this article.The fourth part: Focuses on the ways to solve the problem of private copying undernetwork environment. They are statutory levy system, digital rights management and systemand collective management. The three systems go hand in hand, none is dispensable.The fifth part: Conclusions. It is the generalization and summary of the total content.
