The current system of environmental legislation is based on the "Environmental Protection Law" which is the basic law, a series of environmental protection and pollution prevention as the main single law, supplemented by various environmental standards and local regulations constituted.At the system level, a multi-level and wide-ranging, more comprehensive law department has been formed. Unfortunately, however, heavy metal pollution which is harmful, widly distributed and difficult to control still has no specific legislation to regulate them. What’s more, in the numerous environmental laws and regulations, the laws related to the heavy metal pollution prevention are few, this is the current situation and severely heavy metal pollution in stark contrast to frequent accidents.Not only exist the highlighting contradictions between the two, but also reflect the necessity and urgency of the stage to start heavy metal pollution prevention legislation as soon as possible.As China’s main provinces under the heavy metal pollution prevention’s twelveth five plan, Guangxi, known as " the hometown of nonferrous metals " in the world,is rich in mineral resources. However, the absence of relevant laws and regulations, management system’s not standardized, backward production technology and other factors led Guangxi currently facing a huge crisis of heavy metal pollution. In the past few years, several national large concerning heavy metal pollution accidents occurred in Guangxi, which have a great harmful influence on the local economic development and people ’s health. In this context,under these background, this paper build a sound legal system in Guangxi heavy metal pollution prevention as a starting point with the current status of heavy metal pollution around Guangxi as the basic evidence.The relevant legislation abroad and experience of domestic governance as a mirror. The feasibility and necessity of pollution control legislation analysis and researches have been made under the system of the present stage of heavy metals in Guangxi, according to the local characteristics and ultimately established conditions. The mechanism would be effective through joint prevention and control of heavy metal pollution, regulating the government, corporating and behaving personally, specifically their legal responsibilities.The solution to the dilemma of heavy metal pollution in Guangxi will be found from the origin.
