According to the law, the lessee has the priority selection that at the sameconditions to priority to others to purchase the house property which the lessor sells tothe third party. It is to protect the weak to get their rights and solve their housingdifficulties, the most important is, to maintained their right of existence. However, theproperty industry has a great change in recent years. Renting is not the simple way toresolve the housing problems, but with business model. So the contradiction comesout not only between the reality and theory but also in the lessee priority to purchasethe affordable housing. In the research of the laws from foreign countries, especiallyGerman and Switzerland, finding that there are also some imperfections about the law.From this paper, through the comparing to China and abroad, getting to perfect andmaking the real meaning to all the citizen.
