Research On Perfecting The Educational Administrative Hearing System In China

Introduction of Western hearing system is the requirement of the overall reformof the new era. In China this system has been widely applied in the fields ofadministrative penalties, government pricing and legislative and other administrativehearing system. And they are all defined in legal form clearly. Those kinds of actionshelp a lot to achieve and maintain public interest in a democratic administration. Inrecent years, the scope of application of the administrative hearing system in theadministrative areas continues to expand. Thus aroused widespread concerns on it inacademic field. Hearing in the area of educational administrative is the expanding ofadministrative hearing. As a new thing, which is undergoing continuous developmentand process of improvements. In-depth study from overall and make it play its propersystem value is a question worth of pondering.This paper takes the system of educational administrative hearing in China as thestudying point. By using the literature study method, the case study method, andsupplementing the comparison study method to make a general investigation anddiscussion on the system of educational administrative hearing. This thesis containsthree parts. The first part is the theoretical basis of the specific content and elaborationof educational administrative hearing system. The second part analyzes its problemsin China and issues arising are summarized lead to three reasons. Finally, afterclarifying the above problems, I construct a more complete protection method of thelegitimate interests of the right to protect educational-related legitimate interests. Andfulfill the need of recoup a loss of the law; protect the legitimate right ofeducation-related people. And help them achieve democracy and proper right ineducational administration.
