Research On The Legal Regulation Of Domestic Violence In China

A family is like a cell to society. The harmony and stability of small families are quite important to theharmonious society. On the systematic study of the problem of domestic violence, we found that domesticviolence usually has three characteristics: the close relationship between the parties, high privacy ofdomestic violence incidents, hidden disadvantages and repeated incidents of domestic violence. Thesecharacteristics make relief work quite difficult; domestic violence incidents more described the appearanceof more considerable crisis hidden behind the phenomena. Our anti-domestic violence laws andmechanisms are in Preliminary stage, a sound legal system and supporting systems, coupled withassistance and support of the whole society, might be able to provide effective protection to victims ofdomestic violence, especially women victims. From a global perspective, to introduce a special law againstdomestic violence as soon as possible could be a sign of China’s implementation of the International Bill ofRights. Through the social status quo of domestic violence, as well as research on domestic violenceprevailing legal regulations exposition, this paper discussed about the relief and correction for domesticviolence.This thesis is divided into three parts: The first part is to analyze the concept definition of domesticviolence, the type and characteristics. The second part is to organize domestic violence existing legalregulation and to analyze the personal perspectives on deficiencies of its regulatory system. The third partis about how to further improve the proposed some practical suggestions based on the legal response todomestic violence in our country. The third part described the definition of domestic violence, how toimprove the relevant parts of regulation, the requirement of strengthening the judicial intervention ofdomestic violence, and finally describes the social assistance to domestic violence. This article hopes tocombine the status quo of the establishment and improvement of domestic violence to put forward practicalsolutions for building up and improving the legal aid system.In the process of writing the paper, after in depth study, the system of domestic violence and relatedproblems appeared: China’s current domestic violence rate is still high, with the voice of the internationalcommunity on human rights increasing, we are required to have the right to confront and resolve domestic violence cases. From the perspective of the impact and harm to society, the family violence not onlyseriously damaged the legitimate interests, well-being battered party, and destroyed the family harmony,but also hindered the construction of a harmonious socialist. Therefore, after the analysis of the status quoof China’s domestic violence, improvement for legal regulations concerning domestic violence and socialassistance is an urgent task.
