Research On Patentability Of Gene Drugs In China

As one of the most important product of gene technology, gene drugs also belong to the medical field. Gene drugs are highly valued in every country in the world, because of its huge potential commercial and social value. As the development of gene drugs is more complicated than traditional medicine, more resources are needed for the study of gene drugs. Thus its patent protection is very important. However, whether gene drugs can be patented is a complex issue. At present our country did not make clear rules to this aspect. It is related to both ethical and legal problems.The research on this issue related to the future development prospects of China’s pharmaceutical industry, so it is vital to do some research on it.In this paper, the study of gene drugs is developed through analyzing the issue that whether gene drugs can be patented. After illustrating the status quo of gene drugs patent protection, I put forward the corresponding opinions and suggestions according to the obstacles mentioned previously. And then it brings out the significance of gene drugs patent protection, issues it faced, and try to explore the development direction of patent protection mode of gene drugs.
