The Research On Chinese New Drug Development Status And The Process Of Legal Sanction System Analysis

Chinese medicine industry is one of the special relationship between the nationaleconomy and industry. As people for attention and the health of the aging population trend，people increasingly high demand for health， the pharmaceutical industry has become one ofthe fastest growing industries at present in the world. TCM new drug research anddevelopment of traditional Chinese medicine industry has been the soft underbelly of thefactors which restrict the development of traditional Chinese medicine research anddevelopment of new drugs are mainly two points: First， lack of independent research anddevelopment capabilities， and second， the existing legal system to protect traditionalChinese medicine drug development process is not perfect.In this paper， SWOT analysis analyzes the current situation of Chinese drugdevelopment. The advantages of traditional Chinese medicine research and development ofnew drugs that are very rich in traditional Chinese medicine resources， adequate basis fordrug development reserves， favorable external environment and China’s rapid economicdevelopment of traditional Chinese medicine industry to provide a broad market， but it alsofaces very serious problems， including poor pharmaceutical market competitionenvironment， government policy and the price of drugs in the world to accelerate the pace ofdrug development of traditional Chinese medicine.The main problem of traditional Chinese medicine drug development process existsmainly in the following aspects. First， investment in research and drug developmentseriously inadequate. Drug development takes a huge human， material and financialresources， some of the country’s pharmaceutical business decision-makers to focus only onshort-term profits，but drug development is a long-term investment，they are reluctant to putmoney into research and development of new drugs which， it is difficult to to maintain thecontinuity of research and development， not to mention the drug also protection ofintellectual property and the development of high-quality drugs. Second， patent medicinetechnicians and management personnel lack plaque. Although China has trained a largenumber of Chinese researchers， formed a team with a high level of technology， but to master Chinese patented technology rarely， and only understands technology but alsounderstands pharmacy management， proprietary knowledge and mastery of complex talent ismore shortages. Third， the lack of intellectual property protection for traditional Chinesemedicine drug laws. China’s current system of intellectual property law， intellectual propertyprotection of traditional Chinese medicine has played a certain role，but still need furtherimprovement.This paper also Chinese drug development process legal sanctions system were analyzed.Chinese drug development process is not only illegal fraud diverse behavior， and seriousharm to society， according to the existing laws on the illegal nature of the act provides forcivil sanctions， administrative sanctions， criminal sanctions legal sanction systemframework， but this legal sanctions system， there are still insufficient legal sanctions effortsbetween insufficient sanctions and sanctions phased lack inadequacies coordination，complementarity， etc.， for these deficiencies made perfect suggestions to our new Chinesemedicine research and development faster and better development.
