Freedom of speech is a kind of fundamental rights in the constitution orconstitutional documents in all countries of the world. With the development ofsociety and economy, entities who participate in dealing with the social and economicaffairs also show a trend of becoming diversity, different kinds of entities claim morerights, the entity claiming the right to free speech is also growing. Corporations, as animportant participant in social life, should enjoy more constitutional rights and thishas become a trend. Corporations are no longer just a non-profit organizations. Theform of corporations also began to present diversity. Corporations have began to enterthe country’s political area, economic area, and even every aspect of daily life. Withthe corporations’ power becoming stronger, it is an important question to make thecorporations enjoying basic constitutional rights. Corporations are fighting for theright to freedom of speech in a road full of thorns, in addition, people are talkingabout whether corporations should be given freedom of speech, and what the limits ofthe rights of freedom of speech is. This problem is to explore a development offreedom of speech, and is also a kind of yearning of China’s increasing corporations topersue the constitutional right of freedom of speech.Corporations, as an important participant in social life, should enjoy freedom ofspeech, within reasonable legal scope. In consideration of relevant principles, it is toset legal boundary of freedom of speech in legislation and practice, so as to protectcorporations’ freedom of speech in a better way. As a result, it can make differentkinds of entities participate in social management and contribute own strength for thedevelopment of the society and the country equally. Based on the relatively matureprotection and regulation of corporations’ freedom of speech in legislation andjudicial practice,it is to provide reasonable legal reference for our country’s growingcorporations’ freedom of speech,to establish a legal protection of corporations’freedom of speech in the implementation of the constitution system,and to make surethat corporations can participate in social management and contribute own strengthfor the development of the society and the country and eventually to promote thedevelopment of social and economic in a proceeding way.The researching idea of this paper is: first, giving a brief introduction to therelationship between corporations’ freedom of speech and freedom of speech, and defining the concept of corporations’ freedom of speech as the theoretical basis oflater discussed legal protection and regulation of corporations’ freedom of speech;second, dividing he discussion of corporations’ freedom of speech in three parts, firstof all, discussing how to protect corporations’ freedom of speech and why it should beprotected, then discussing how to regulate corporations’ freedom of speech and why itshould be regulated, then discussing how to protect and regulate the media’ freedomof speech; finally, discussing the foundation of corporations enjoying the right offreedom of speech in China’s constitution, then considering the actual situations ofprotection and regulation of China’s corporations’ freedom of speech, introducing thedetailed steps for protection and regulation of China’s corporations’ freedom of speechand to make corporations exercise the rights of freedom of speech in a right way.
