The Qing dynasty is the last one of feudal autocracy in the ancient history ofChina, which has a special historical significance. On the one hand, it as a ethnicminority had to entered and hosted the central plains, and it took measures toconsolidate the regime and construct the social and political system, which washelpful for the reunification of China and laid a basic territory for the futuregenerations. On the other hand, it faced lots of problems in the processed of managingsuch a large empire, All these made absolute monarchy reach its peak in Qingdynasty which is the dynasty of crisis lurks at the same time. Under such a socialbackground, human trafficking was one of the inevitable and common socialphenomenon.Firstly the author gives a clear explanation of human trafficking which is illegaltrafficking, and then discusses the origin and development process of humantrafficking before the Qing dynasty society, especially pay attention to the evolutionof this kind of phenomenon in the Qing dynasty society. In addition to, the authordiscusses the intermediaries, activity form and arena related to human trafficking.Including the legal definition of kidnapping and selling people. The age, price, thesource and reason of the trafficked people, and where would be sold. Besides theselling activities, methods, and traffickers’ ways for crime and motive.Secondly, the author discusses the Qing Codes to the human trafficking’ssentencing convicted. Mainly from legal definition of kidnapping and selling peopleaccording to the Qing Codes, penalties for human trafficking, temptation and willingtraffic.At last, in view of the process of human trafficking according to the Qing Codesbasing on juridical practice. The author discuss the two aspects from the Qinggovernment in the judicial practice show the law-abiding and deviate from the law forthe sake of analyzing the government in the social role how to solve humantrafficking. At the same time, further discusses the reason of crime continuing despitethe Qing government repeated prohibition.
