The Legal Research On Trafficking Of Women And Children In The Qing Dynasty

The legal matter of trafficking of female and teenagers in the Qing Dynasty is researched in this thesis.Retrieving the code of ancient China,there is no lacking of regulations which is about human trafficking.It follows that human trafficking was common in ancient China.In addition,it had been a crime which was severely punished by the government of every dynasty,so did the Qing Dynasty.Women and children were the main objects of human trafficking in Qing Dynasty.In the 43 cases of Summary of Criminal Cases,there were 37 cases of female victims,16 cases of children victims,which showed that women and children were the main victims.The price of the victims is related to their own conditions,and is also affected by the price levels of different periods and regions,ranging from 5 liang to 400 liang.The victims of women and children mostly came from Yunnan,Guizhou,Sichuan and other underdeveloped areas.Boy was sold as a son,some of the women were sold as wives,some were sold as slaves,some became prostitutes.In the cases of human trafficking,human trader played an important role as an agent.They made a case in the way of robbery and kidnapping in order to pursuit of economic interests.Some of the did the case alone,some of them did a gang crime,which causing a great harm to society.To this end,the Qing Dynasty took a severe punishment on it.The law of Qing Dynasty about trafficking of women and children was perfect,so did the punishment.There are special provisions on criminal behavior in different ways,such as inducing and selling and,in the judicial practice also can do basic statutes according to punishment for crime prone to adopt special punishment for special circumstances can be flexible,considering human factors.However,due to the injustice of some officials,the low status of the feudal patriarchal system and the status of the women and children,and the poverty of the victims' families,it is impossible to put an end to the problem of tracking of women and children.Today,trafficking in women and children is still a serious social problem,there are tens of thousands of women and children were forced to separation from their family,tens of thousands of families was reduced to fragments every year.Studying the law of Qing Dynasty has reference significance for today.We need to consummate the legislation,improve the quality of the investigators,attach importance to the punishment about buyers to let fewer people suffer,and make the law warmer.
