Application Study Of Infringement Cases In Litigation Strategy Of Enterprises

With the progress and development of technology, Enterprise pay more attentionto protect the intellectual property. Especially in emerging technologies, thetechnology compition between enterprises has become more intense. Consequently,the infringement cases also has been increasing. Patent litigation has become aninevitable problem in the business process. Full use of the value information ofinfringement cases is significant to avoid the risk of litigation and formulate effectivelitigation strategy.At present, the domestic research on enterprises infringement mainly focuses oncase review, relevant legal explanation and litigation behavior reasearch. Theseresearchs couldn t excavate the Infringement cases deeply and lack practicalapplication. In this paper, Data mining, social network analysis and patent analysiswill be used to excavate the litigation information, assist enterprises to establisheffective litigation strategy.First, analyze the litigation status of LED enterprises, including the annualdistribution of infringement cases, key enterprises involved in the litigation and fieldsdistribution of litigation patent. It can help enterprise to have a preliminaryunderstanding of litigation status.Second, analyze the patent features which involved in the litigation and buildprediction models of risk patent. The independent samples T-test will be applyed toidentify the differences indicators between litigation patent and general patent. Basedon the results, we can summary the feature of litigation patent. Data mining will beapplied to buid prediction models of risk patent, assisting enterprises to identify therisk patent.Third, analyze the hotspot and trend of litigation, including the areal distribution,enterprises distribution, technology distribution, the application hotspots and its trend.It can help enterprise to identify the litigation risk.Last, analyze the litigation relationship between enterprises, including networkanalysis of relationship among enterprises and risk patent layout analysis of leadingenterprise. It can help enterprises to recoganize their status, characteristics andexternal threat of litigation.
