On The Perfection Of Procuratorial Committee System

China’s current leadership decision-making body of procuratorial organs is theattorney general and procuratorial committee(hereinafter referred to as procuratorialcommittee),carrying out the system that is the combination with the determinedrespectively by the attorney general and the collective leadership, and this system isdeveloped for combining with the national conditions of our country in socialism primarylevel. The procuratorial committee system is a peculiar procuratorial system in China andis an important organization form that the collective leadership decision is theprocuratorial organ implementing by the procuratorial organ interior, which plays a role inpromoting the scientific development of procuratorial work,pushing on the careerdevelopment of public prosecutors, improving the ability and level of law enforcement ofprocuratorial organs and so on, but with the continuous process of promoting the rule oflaw in our country, the defects in the system is increasingly obvious, highlighting thefollowing questions, such as,the motion of heavy light, unclear function orientation,irregular operating procedures and so on. So the internal academic circles and theprocuratorial committee have formed a sound that is the reform of the procuratorialcommittee, despite various problems are exposed in the procuratorial committee system,but from procuratorial committee in the practice of our country and the national conditionsof our country in socialism primary level, it is not reality and mature to eliminate thesystem fundamentally, so it should be retained and we shall reform and perfect it. Duringworking at grass-root procuratorate, I devoted myself to procuratorial committee officework for two years, so I have a deep understanding about it. This paper, taking theimprovement of the system of procuratorial committee as the research object, combiningthe theory of academic research on procuratorial committee work and my own workingpractice, analyzes the current system that is existing scope of accepting cases is notesplicit, the access mechanism imperfect, group decision accountability and a series ofproblem. I put forward some humble opinion and evaluation about the current related law,put forward some suggestions about legislative perfection, striving to provide somesupport for the reform and innovation of procuratorial committee.
