Mexico Anti-dumping Law And China’s Countermeasures

Since the establishment of diplomatic relations with Mexico in1972, bilateraltrade between China and Mexico has been steady and rapid development by jointefforts of the two governments. Mexico as a Latin American economic power, notonly rich in natural resources, also has the North and South America, Europe and Asiaregions to facilitate the geographical advantage. China and Mexico in trade andinvestment cooperation has huge potential for development. However, the continuousdevelopment of bilateral trade, trade conflicts are frequent. Tariff barriers in thetraditional way of trade protection have been difficult to access. In this situation,anti-dumping as a means of trade protection allowed by WTO naturally became anational popular means of trade protection, Mexico is no exception. Since1991,Mexico launched the first phase of anti-dumping investigation on China; China hasbeen the focus of anti-dumping investigation in follow decades. Placed on file only inrespect of1993involving a class of more than4000kinds of Chinese top ten exportproducts, and placed on file on the same day beginning at16%to1105%levy aninterim antidumping duty offset. Its high scale of anti-dumping tax is unprecedented.In recent years, China’s trade deficit with Mexico which trend is still growing, and theinternational financial crisis Mexico’s antidumping in the long term trend is still rising.Mexican anti-dumping investigation initiated on China not only quantity, involving awide range of products, but also has a win rate, high anti-dumping duty as well asdeparture from WTO rules, discrimination and many other features. However, due tovarious reasons, our country did not pay enough attention to anti-dumping of newlyindustrialized countries like Mexico which leads to make the Mexican anti-dumpingand fruitful, not only directly affect the China-Mexico trade, health development, butalso for other countries in China a sign of weakness negative image. Our country’sexport-oriented economic development strategy created a serious obstacle. Therefore,we should seriously study the Mexican legal framework and anti-dumping practices,and actively seek better deal with the Mexican anti-dumping related strategies.This paper is divided into three parts; the first chapter introduces thedevelopment history of the Mexican anti-dumping legal system and the rules ofentities and procedures of Mexico’s anti-dumping laws. The second chapter refers to Mexican anti-dumping cases against China and its influence on our country. And thensum up the main features of anti-dumping imposed on China by Mexico. The last ofMexico’s anti-dumping in China frequently and external reasons. In the third chapterdeal with in long coverage the legal countermeasures against anti-dumping of Mexicoand some responding measures.
