Research On Marine Law Enforcement Issues And Countermeasures Of China Coast Guard

The1stconference of China NPC deliberated and passed “the StateCouncil’s Institutional Reform and government functions’Transformation” in March14,2013. It would establish the new StateOceanic Administration (SOA). SOA would carry out the maritime lawenforcement duties and safeguard legal rights in name of China CoastGuard(CCG). However, at present, because of the imperfection and thelag of related laws and regulations, it’s still some hot issues for the newCCG to enforce the law at sea, such as the lack of legal basis and so on.These issues badly restricted CCG’s law enforcement tasks. They wouldalso make difficulties for CCG to safeguard the national sea rights andmarine security. Some specialists and scholars have researched on themarine marine law enforcement system before me, but they have seldommentioned law enforcement by the new established administration CCG.The thesis has five chapters. Chapter1is a brief introduction of thedevelopment and integration of CCG, the characteristics and principles ofmarine law enforcement system. Chapter2is a deep analysis of the China marine law system construction, the deficient point of the legal basis oflaw enforcement activities by CCG. Chapter3is a concrete analysis ofthe defect and causes of enforcing the law at sea by CCG. Chapter4, mystance, is the countermeasures and suggestions to CCG marine lawenforcement system.
