Research On The Standardization Of Marine Police Law Enforcement

In the case of the development of national strategy of marine power construction and deployment of "The Belt and Road" initiative,China's attention to maritime rights has increased to an unprecedented level.As a safeguard of national maritime rights and interests and maritime law enforcement,the China Coast Guard was reorganized in 2013,which is responsible for the comprehensive law enforcement duties of the original maritime patrol,fishery administration,maritime police and anti-smuggling police.For safeguarding state sovereignty and maritime rights and interests,supervising and managing the development of marine resources,maritime rights and interests protection,maritime search and rescue and emergency response,sanctions against maritime crimes and terrorist attacks,etc,maritime law-enforcement has a vital significance.Therefore,the degree of standardization of maritime law-enforcement has also received wide attention.Taking the law enforcement status of the maritime police bureau as the breakthrough point,compared with the maritime police department of the international maritime power horizontally,compared with the original law enforcement system vertically,this paper analyzes the problems existing in the current maritime police law enforcement standardization,and puts forward corresponding countermeasures by focusing on the main body of law enforcement,legal basis,law enforcement team building and maritime police law-enforcement capabilities.The first part.Starting with the reform of the maritime police,the first part analyses the status quo of the standardization of maritime police law-enforcement,and analyzes the problems existing in the standardization of China's maritime law-enforcement and profoundly analyzes its causes.The second part.From the marine legal system,the establishment of maritime police institutions,and the construction of law enforcement equipment,through the horizontal comparisons between China and coastal countries such as the United States,Britain,Japan,South Korea,Canada,Russia,India and Philippines,the second part analyzes the difference between China's maritime police and other countries,and draws inspiration for China's maritime police to standardize law-enforcement.The third part.The third part mainly analyzes the countermeasures to strengthen the standardization of law enforcement of marine police.One,establishing a comprehensive marine law enforcement mechanism,and establishing a modern coast guard mechanism;two,constructing the professional system of maritime police academy,offering special subjects,improving education and training,and deepening exchanges and cooperation,so as to strengthen the training mode of talents,and train the maritime law-enforcement personnel;three,taking the formulation of maritime police law enforcement standard system,standardizing the qualification of law enforcement personnel,and carrying out law enforcement supervision according to law as the handle,so as to improve the law of law enforcement,and standardize maritime law enforcement procedures;four,continuously strengthening the construction of marine police equipment,so as to strengthen maritime law enforcement ability,and improve the law enforcement ability of the maritime police;five,strengthening international exchange and cooperation,and promoting the promotion of joint law enforcement,so as to achieve the purpose of avoiding diplomatic disputes caused by law enforcement;six,formulating and promulgating the marine basic law and the maritime police law,revising and perfecting marine law and other marine laws,so as to improve the marine legal system,and perfect the basis of maritime law-enforcement.
