The Research Of Conditional Non Prosecution Of Juveniles

Article271of special procedure for juveniles in Amendment ofCriminal Procedure Law is enacted that legal system for juvenilesimmune to prosecution with condition, by the People’s Republic of Chinain2013, in order for protection of the juveniles health growth． It is greatbreakthrough that legal system for conditional non prosecution ofjuveniles in the field of criminal legislation for juveniles and judicialpractice, which is beneficial to achieve special protection forjuveniles． However, there is still some space to be improved in code oflegal system for conditional non prosecution of juveniles, such asspecification of related procedure, enactment of additional obligations,perfection of restriction mechanism, and so on．As the author of this paper, I would review the background of legalsystem for conditional non prosecution of juveniles in the People’sRepublic of China and explain the legislative value in new edition ofCriminal Procedure Law． The legal significance differently occurs in relatively non-prosecution and criminal reconciliation via analysischaracteristics of legal system for conditional non prosecution． Theanalysis is combined with characteristics of own country and comparisonwith legal system for conditional non prosecution in foreigncountries． Since the commit legal system for conditional nonprosecution in China, there have been several problems in the field ofjudicial practice, so that the thesis just gives the summaries about start theprocedure for legal system for non-prosecution and recommendations forestablish standard procedures for hearings and does research during spanof investigation of legal system for conditional non prosecution and legalsystem of help and education, study the restraint mechanism on legalsystem for non-prosecution and remedies and offer suggestions oneligible mechanism for legal system for conditional non prosecution andremedies．...
