Research On Conditional Non-Prosecution System

With the diversified development of the society,the juvenile crime rate in our country has increased greatly.In line with the principle of "education,rescue and reform",a conditional non-prosecution system with Chinese characteristics has been formed.The minor criminal cases of conditional non-prosecution can be solved in the prosecution stage,which not only improves the efficiency of litigation but also saves the judicial resources.However,there are many problems and inadequacies in the practice of the system of conditional non-prosecution of minors,so it is necessary to study,summarize and improve it.In this paper,the function and value basis of the legal system is briefly described,and combined with the current situation of China's legislation and relevant foreign systems,some theoretical analysis and thinking are done to improve China's conditional non-prosecution system,so that the system can more effectively solve the problem of juvenile delinquency in China.
